Court stays demolition of property linked to Al-Falah University chairman

The Madhya Pradesh High Court has issued a 15-day interim stay on the demolition of a property linked to Al-Falah University chairman Jawad Siddiqui in Mhow. The stay was granted on a petition filed by one Abdul Majid, who resides in the house with his family. The court's order effectively freezes all action by the Mhow Cantonment Board for 15 days.

Demolition notice challenged over lack of clarity

Majid had challenged the demolition notice on several grounds, including that the board did not specify which part of the structure was allegedly unauthorized. He argued that the notice relied on documents from 1996-97, rather than current conditions. The petitioner also pointed out that the notice did not comply with the Supreme Court guidelines for demolition proceedings.

Ownership transfer and demolition notice issued

The petition clarified that the house was originally owned by Siddiqui's father, Hammad Siddiqui, who later gifted it to his son. Jawad then gifted the property to Majid. Despite this ownership transfer, a demolition notice with a three-day ultimatum was issued by the Cantonment Board. The notice by the Mhow Cantonment Board had instructed "the current occupant or legal heirs of the property to remove the unauthorized structure within three days."
