IIT-JEE topper's Rs. 5cr lawsuit against FIIT-JEE

The Delhi High Court has pulled up renowned coaching institute FIIT-JEE for not willing to settle the claims of an IIT-JEE topper.

The suit was filed way back in 2009 when IIT-JEE topper Nitin Jain sought damages worth Rs. 5.85cr from FIIT-JEE for allegedly misusing his name and achievements to promote the institute.

FIIT-JEE, of course, denied all claims.

In 2009, Nitin Jain sought damages worth Rs. 5.85cr from FIIT-JEE for luring students for admission through the misuse of his videos, photos, and achievements, thereby breaching his and his family's right to privacy.

The plea added that the practice had gone on despite repeated objections submitted to FIIT-JEE in both oral and written form.

Jain's videos were also allegedly submitted to porn sites.

Nitin Jain has a stellar list of achievements

Nitin Jain, apart from IIT-JEE, topped AIEEE in 2009. Earlier, in 2007 he won the National Talent Search Examination (NTSE), and in 2008-09, won three gold medals at International Science Olympiads held in Indonesia, Mexico, and Iran. He currently works for Google in San Francisco.

Legal proceedings

The next hearing of the case is in August

Following the filing of the lawsuit, FIIT-JEE denied all allegations and claimed that Nitin Jain was not entitled to any damages.

However, in 2011, the Delhi High Court restricted FIIT-JEE from using Nitin's name or photographs for any sort of commercial gain in the future.

The next hearing of the case has been posted for August 31.

Nitin Jain did his classroom coaching of two years from FIITJEE and a correspondence course from Aakash.

Using a person's photographs and videos are generally subjected to copyright and require the respective person's permission. If they are used without the respective person's will then it is not legal.
