A constable of Uttar Pradesh police, who has been booked for the custodial death of the father of Unnao rape survivor, moved Delhi High Court on Wednesday challenging the charges leveled against him.
Constable Amir Khan pleaded that a trial court had "wrongly" joined two cases. One of them was sessions triable and other was a magisterial triable case, he argued.
Context: Rape survivor's father was arrested, died in judicial custody
In 2018, a teen attempted self-immolation outside the residence of Uttar Pradesh Chief Minister Yogi Adityanath. She claimed that now-expelled BJP MLA Kuldeep Singh Sengar raped her in 2017, but no one took cognizance of her complaints.
After she took the extreme step, police, shockingly, arrested her father, who later died in judicial custody.
Sengar, nine others, were charged for survivor's father's death
The rape case, as well as the victim's accident, is being investigated by CBI.
After the horrendous case got attention, the Supreme Court stepped in and directed that all matters related to Unnao rape should be shifted out of UP to Delhi.
On August 13, a trial court charged Sengar and nine others for their involvement in the death of survivor's father.
Sengar got an FIR registered against victim's father: CBI
Notably, the CBI had told District Judge Dharmesh Sharma that Sengar and his aides got the victim's father framed in an Arms Act case.
They got an FIR lodged against him for "possessing" a country-made pistol, CBI told the court.
The FIR also accused the victim's father of verbally abusing Atul Singh Sengar, Kuldeep's brother, and others involved in the case.
Apart from Khan, two other cops were booked by court
Further, CBI claimed three police officers allegedly assaulted the victim's father. These included the then Makhi police station's in-charge Ashok Singh Bhadauria, Sub Inspector Kamta Prasad and constable Khan.
After the cops were charged with murder, the court also canceled their bails.
The other accused in the case are Shailendra Singh, Vineet Mishra, Birendra Singh, Shashi Pratap Singh, Ram Sharan Singh, and Atul.
