Allahabad High Court dismisses rape case over broken marriage promise
The Allahabad High Court has thrown out a rape case that started after a woman accused her partner of breaking a promise to marry her.
Justice Vivek Kumar Singh made it clear that not every breakup should end up in court, saying, "it is neither inevitable nor assured that every romantic relationship will result in marriage."
The court stressed the importance of personal choice and autonomy in relationships.
HC finds no deception in consent
Back in 2019, the woman filed charges against her partner for rape and intimidation after he refused to marry her, even though their relationship had been consensual.
They eventually got married later that year, but she continued with the case, citing mistreatment during marriage.
The court took note of her education and maturity and decided there was no deception involved in her consent.
In the end, the judge called continuing the case gross misuse of criminal jurisdiction, reminding everyone not to use legal action for personal grievances.
