Supreme Court takes up intersex rights case
The Supreme Court has sent a petition on intersex rights to a three-judge bench.
Filed by Gopi Shankar M, the case challenges an old judgment that mixed up "sex" and "gender," and pushes for better legal recognition of intersex people in India.
Why does this matter?
Intersex individuals—born with traits that don't fit typical male or female categories—often face discrimination, misidentification, and even non-consensual surgeries.
The petition asks for changes like recording intersex births separately, adding them as a category in the Census, banning unnecessary medical procedures on minors nationwide, and making sure official documents recognize both "sex" and "gender."
Without these updates, many intersex people struggle with access to education, jobs, and basic rights.
