SC stays POCSO case against former Karnataka CM BS Yediyurappa
What's the story
The Supreme Court has temporarily halted the trial proceedings against former Karnataka Chief Minister BS Yediyurappa in a Protection of Children from Sexual Offences (POCSO) case. The decision was taken by a bench headed by Chief Justice of India Surya Kant and Justice Joymalya Bagchi, according to Bar & Bench. The court issued notice to the state government on Yediyurappa's plea, clarifying that it was to consider remanding the case back to the High Court.
Case background
Allegations against Yediyurappa and legal proceedings
The case against Yediyurappa stems from a complaint filed by a deceased woman on March 14, 2024. She accused the former CM of molesting her 17-year-old daughter during their visit to his residence for assistance. The complaint also alleged that Yediyurappa tried to bribe her with money to cover up the incident. An FIR was registered under Section 8 of the POCSO Act and Section 354(A) of the Indian Penal Code (IPC).
Legal developments
High court's decision and Yediyurappa's appeal
On July 4, 2024, a trial court took cognizance of the case against Yediyurappa and three others for offenses under Sections 204 and 214, read with Section 37 of the IPC. However, this order was quashed by the Karnataka High Court on the grounds that it was cryptic and passed without proper consideration. The trial court was then directed to reconsider its decision on cognizance.
Ongoing proceedings
Yediyurappa's plea in Supreme Court
On February 28, a Fast-Track Special Court issued a fresh cognizance order summoning Yediyurappa and others to appear on March 15. Challenging this order, Yediyurappa moved the Karnataka High Court, claiming the allegations were politically motivated and inconsistent. The High Court refused to quash the case last month, prompting him to file a plea in the Supreme Court.
