Allahabad HC gives Humaiyra Riyaz another chance to claim maintenance
The Allahabad High Court has given Humaiyra Riyaz another chance to claim maintenance after her plea was earlier denied because she remarried before her first divorce was legally recognized.
The court clarified that under Mohammedan Law, a talaq (divorce) counts from the moment it is pronounced (not just when it is officially validated), so the earlier decision missed this key point.
HC remands case to family court
The High Court also pointed out that the family court should have treated the divorce decree as proof of an effective talaq.
Riyaz's lawyer shared that her second husband, who earns well as a government employee, refused to support her and their two children.
Now, the case goes back to the family court for a speedy review (hopefully wrapping up in six months), so all facts and legal details get fair consideration.
