Allahabad High Court: husband's maintenance obligation survives death, father-in-law liable
India
The Allahabad High Court just ruled that a husband's responsibility to financially support his wife continues even after he passes away.
If there isn't enough left in the husband's estate, her father-in-law is expected to step in.
This came up after a man accused his wife of making false claims for maintenance.
Judges reject Akul Rastogi's maintenance challenge
Akul Rastogi tried to overturn a previous court order by saying his wife lied about her job and finances.
But the judges didn't find any proof of this and clarified that not sharing every financial detail isn't the same as lying under oath.
Bottom line: the husband still has to provide maintenance under Hindu law, no matter what.
