Delhi HC cancels property gift after elderly woman reports neglect
The Delhi High Court has canceled a property gift deed that 88-year-old Daljit Kaur gave to her daughter-in-law, Varinder Kaur, after Kaur said she was neglected, denied medical care, and threatened.
The court emphasized that when seniors transfer property to family, it's expected they'll be cared for in return—something based on "love and affection."
How the case played out
Kaur first asked authorities to cancel the deed back in 2019 under a law protecting senior citizens, but her request was initially denied.
Later, the District Magistrate stepped in and ordered the cancelation.
When the daughter-in-law argued that only deeds with written maintenance promises could be canceled, the High Court disagreed—saying all evidence counts and failing to care for elders after getting their property can amount to fraud.
This ruling aims to protect seniors from being left helpless by family members after handing over their assets.
