Delhi court permanently bars Sainus Pharmaceutical from using 'Udaan' trademark

A Delhi court has permanently barred Sainus Pharmaceutical, based in Hyderabad, from using the Udaan trademark after a legal complaint by RSPL Health.
RSPL, the company behind Ghari detergent and owner of the Udan mark since 2007 for its sanitary napkins, argued that Sainus's use of a nearly identical name was confusing for customers.
Court orders destruction of 'Udaan' counterfeits
The judge found the two names were so similar they could easily mislead people.
Since Sainus didn't show up to defend itself in court, the judge ordered a stop to its use of Udaan.
All counterfeit products must also be surrendered for destruction, especially since RSPL said these goods were being sold in New Delhi markets and could trick unsuspecting buyers.
