    EC files FIR against Rahul for interview on Gujarat-poll eve

    What's the story

    On the eve of the Gujarat polls' second phase, BJP and Congress again exchanged a war of words. This time it involves Rahul Gandhi's interview to a Gujarati TV channel which violated the 48hr ban on campaigning.

    EC contended that the interview discussion comes within the purview of "election matter" elaborated in the Representation of People Act, 1951.

    What is EC's argument?

    The model code bars political parties from talking about elections, 48hrs before polling. Further, the media is not allowed to broadcast anything related to polls after 5pm on December 12.

    EC said, the Congress chief by giving the interview and TV channels by broadcasting it, had violated the model code, RP Act and EC's instructions.

    EC ordered that FIRs be filed against those involved.

    Union minister Piyush Goyal said, "The Congress is so scared and Rahul Gandhi is desperate to save his face. That is why he violated the Model Code and gave interviews." He claimed BJP had never given such interviews.

    Congress accuses EC of double standards

    In their defense, Congress spokesperson, Randeep Surjewala attacked EC.

    He said in 2014, Modi showed the BJP symbol on voting day.

    Modi conducted public meetings on December 9 (Gujarat polling's first phase) and BJP chief Amit Shah and Goyal addressed two press conferences on December 13. However, no action was taken against them.

    He questioned "Are these not double standards? Let there be accountability."

    Meanwhile, Congress seeks action against senior BJP leaders

    Meanwhile, Congress asked that action be taken against Gujarat CM Vijay Rupani and BJP state chief Jitu Vaghani for threatening journalists with action if they aired Rahul's interview. BJP denied these allegations saying they had advance information about the interview and had just informed EC.

    Future course

    What is the future course of action?

    EC asked Rahul to give an explanation for the model code's violation by December 18. However, if he doesn't respond, the matter will be decided without referring to his version.

    Further, Gujarat's chief electoral officer, BB Swain said rules prohibiting campaigning do not amount to a "gag order." He said they have acquired the interview CD and action will be taken after watching it.
