What's the story

The Delhi High Court has permitted IRS officer Sameer Wankhede to pursue his defamation case against the Netflix show The Bads of Bollywood in a Mumbai court. The court, led by Justice Vikas Mahajan, ruled that the Delhi court lacked territorial jurisdiction over the matter. The series is produced by Shah Rukh Khan's Red Chillies Entertainment and directed by his son, Aryan Khan.

Legal proceedings

'Wankhede filed application seeking transfer of case'

Wankhede's counsel informed the court about a January 29 ruling by Justice Purushaindra Kumar Kaurav, which had returned the plaint under the Civil Procedure Code. This decision allowed him to approach a competent forum in Mumbai. Wankhede then filed an application under Order VII Rule 10A of the CPC to transfer the case to Mumbai. The court approved the request, allowing the suit to proceed in the City Civil Court.

Defamation allegations

What is the case about?

Wankhede had earlier approached the Delhi HC claiming that a character in the first episode was a defamatory portrayal of him. He sought directions for removal or restraint on certain scenes, arguing that the depiction harmed his reputation and dignity. Wankhede argued that the character's appearance, behavior, and mannerisms were strikingly similar to his own. Notably, Aryan was arrested by Wankhede during the infamous Cordelia cruise raid case in October 2021 but was later exonerated by NCB in May 2022.
