Bombay HC upholds elderly parents' rights
The Bombay High Court just ruled that parents aren't legally required to let their grown-up children and in-laws live in their self-owned house if they don't want to.
This decision came after an elderly couple, who had once welcomed their son and his wife home, asked them to leave when family tensions and disputes got out of hand.
Couple ordered to vacate, son told 'rights not permanent'
The court made it clear: just because parents allow you to stay doesn't mean you get permanent rights over the property.
The couple was ordered to vacate within 30 days, and fined for not following earlier payment orders.
The judgment also reinforces that under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, senior citizens have the right to live peacefully in their own homes—permission isn't the same as ownership.
