Gauhati High Court rules 'Talaq-e-Hasan' legally valid in India

The Gauhati High Court just confirmed that Talaq-e-Hasan, a traditional Islamic way of divorce, is legally recognized in India.
This came after an Assam man tried to register his divorce using an old, now-canceled law from 1935.
The court told him to use the updated Assam Compulsory Registration of Muslim Marriages and Divorce Act, 2024 instead.
Gauhati High Court allows wife challenge
Unlike instant triple talaq (Talaq-e-Biddat), which was banned by the Supreme Court in 2017, Talaq-e-Hasan involves saying talaq three times over a few months.
In this case, the husband followed those steps on March 22, April 26, and May 27 this year.
The court also made it clear that even if the wife wasn't present at the hearing, she can still challenge the divorce later if she wants.
