Kerala HC throws out rape charges in broken marriage promise case

India

The Kerala High Court has dropped rape charges against a man who was accused of backing out of a marriage promise.
The woman said he'd promised to marry her but ended up marrying someone else.
Their relationship started back in 2009, while she was still married, and continued after her husband passed away.

Why the court let him go

The judge said their relationship was consensual and there wasn't proof that he tricked her from the start.
Since she was legally married when things began, the court pointed out that marrying her at that time wasn't possible anyway.
Without clear evidence of deception or a formal complaint for other charges, all criminal proceedings were quashed—highlighting how courts look for actual deceit, not just broken promises or emotions, in these cases.
