Justice Brijgopal Harkishan Loya was a Judge of a special Central Bureau of Investigation (CBI) court, presiding over the Sohrabuddin Shaikh encounter case. In 2005, Shaikh along with his wife and aide Tulsi Prajapati, were allegedly killed by a joint team of Gujarat and Rajasthan police. Shaikh’s family appealed in the Supreme Court, alleging a case of fake encounters, and the case was taken up by the CBI. After filing a charge sheet in 2010, CBI arrested senior BJP leader and the then Gujarat Home Minister, Amit Shah. In 2012, the case was transferred from Gujarat to Mumbai, and in 2014, the previous judge, JT Utpat, was replaced by Justice Loya. In December 2014, Loya had gone to the wedding of a colleague’s daughter along with four other judges in Nagpur, where he reportedly died of cardiac arrest. After suspicions were raised by some media reports and opposition parties alleged the involvement of Shah, petitions demanding an investigation into Loya’s death were filed in the Supreme Court. A three-judge bench headed by Chief Justice Dipak Mishra gave its verdict, terming Loya’s death to be natural.
